We respect the privacy of artist members as well as visitors to this site. Your personal information will not be made available to any third party for marketing purposes without your explicit consent.

This privacy policy (“Policy”) is issued by SunFox Web Creations (“Host”) and contains information pertaining to the domain, and any subdomains of, enchantedsouthwestartists.com (“Site”). You as either an artist member (“Artist” or “You”) or visitor (“Visitor” or “You”) are entitled to all considerations set forth in this Policy. Please be sure to visit this page on occasion to view any updated information.

This Policy is in effect in conjunction with the User Agreement (“Agreement”). Please read both documents carefully. Any questions may be addressed to the Site curator.

  1. Information Collected by Host
    1. The Host may collect certain information from You to ensure You receive all available services to which You are entitled while participating in the Site.
    2. Visitors may for the most part browse the Site anonymously. In the event You reveal yourself to Host by requesting information or applying for membership, Host will use the information received only as it was intended to be used. For example, Visitors may wish to provide contact information on forms in the event they desire a response by the Host. Host uses this contact information only for the purpose of contacting the Visitor. It will not be further utilized except to further contact the Visitor to inform Visitor of any potential items in the future in which Visitor expressed an interest (as indicated on the original request submission).
    3. Visitors may also wish to purchase items from Site. In this event, Host may need to collect financial information from Visitor depending on payment terms (i.e., credit card or bank information). Host will also require contact and shipping information.
    4. Certain information, such as Your entry URL, browser, and IP address, is available to Host through server-provided web statistics. If you choose to submit information to Host, You agree that Host may use this information to contact You concerning any relevant information or promotions in which You have indicated interest. This information will only be used by Host, and not released to third parties without Your explicit consent.
    5. Member Artists must submit certain information to Host. At the very minimum, Host will require a legal name and mailing address. Depending on membership payment form, Host may need to collect financial information (i.e., credit card or bank information). Host may also request verification of Artist’s identity.
    6. As a security measure, Your IP address will be logged when registering, uploading, or using member services.
  2. Information Not Collected By Host
    1. Host will not collect any sensitive information about You unless necessary for financial transactions, tax purposes, or any other reason that necessitates collection of such information, or unless provide voluntarily. Visitors may remain anonymous if they choose. Visitors may choose to give Host certain information; in the case of form submission, certain information is optional depending upon the purpose of the form submission. Visitors are under no obligation to provide Host with any information; however, certain requests may not be honored and certain services may be unavailable if required information is not provided.
    2. Host does not employ “cookies” on this site at this time; however, Host does not control third-party cookies. A “cookie” is a small file placed on your hard drive which is created by a script within a web page and read by that page when you return to it, allowing certain information to be retrieved and used, usually to customize the page according to a determined preference. At this time there should be no cookies encountered anywhere on the Site.
  3. Disclosure
    1. Disclosure to most third parties is made only with Your explicit consent. Host may disclose certain information to the following parties without your consent:
      1. Service Providers for Host Operations
        1. In the event Host outsources any work performed for the benefit of the Artist and/or the Host, certain information on You may need to be disclosed. Any service provider used by Host will be governed by this Policy, its own privacy policy, and legal restrictions as to the use of Your information.
      2. Government Entities
        1. Host may be forced to disclose certain information about You at the legal request of law enforcement entities.
        2. Host may be forced to disclose certain information about You at the legal request of tax, treasury or revenue agencies.
      3. Other Entities with Lawful Request
        1. Any entity in possession of a warrant or other legal document authorizing the seizure of such information may be able to obtain such information on You in Host’s possession.
  4. No Warranty Implied
    1. Notwithstanding the information contained within this Policy, no guarantees are made concerning the privacy of Your information.
    2. Although Host will employ all measures to enforce this Policy and ensure your confidentiality, certain acts and occurrences not under Host control have the potential of making Your information vulnerable to disclosure. Such acts and occurrences include, but are not limited to: third-party interception, violations of this Policy by individuals not under Host control, natural disaster, man-made disaster, acts of God, civil disturbance, terroristic acts, war, nuclear disaster, interference by extraterrestrial life, interference by extraterrestrial vehicles, piracy, paranormal activity or unexplained phenomena.
  5. Notices
    1. This Policy pertains only to the use and disclosure of information collected by Host. In no way does this Policy address Your disclosures to other third parties.
    2. This Policy is subject to change. Any revised version of the Policy will take effect thirty (30) days from the date of its posting on the Site.
